INSTAGRAM TERMS OF USE & PRIVACY POLICY (Excerpt) 1. DATA WE COLLECT We collect the content, communications and other information you provide when you use our Products, including when you sign up for an account, create or share content, and message or communicate with others. This can include information in or about the content you provide (like metadata), such as the location of a photo or the date a file was created. We also collect information about how you use our Products, such as the types of content you view or engage with; the features you use; the actions you take; the people or accounts you interact with; and the time, frequency and duration of your activities. Device Information: We collect information from and about the computers, phones, connected TVs and other web-connected devices you use that integrate with our Products, and we combine this information across different devices you use. Location-related Information: We collect location-related information, such as your current location, where you live, the places you like to go, and the businesses and people you're near. 2. HOW WE USE YOUR INFORMATION We use the information we have to deliver our Products, including to personalize features and content and make suggestions for you on and off our Products. We use your information to develop, test and improve our Products, including by conducting surveys and research, and testing and troubleshooting new products and features. 3. HOW INFORMATION IS SHARED We share information globally, both internally within the Meta Companies, and externally with our partners, third-party companies, and service providers. We work with third-party partners who help us provide and improve our Products or who use Meta Business Tools to grow their businesses, which makes it possible to operate our companies and provide free services to people around the world. 4. YOUR RIGHTS AND CONTROLS We provide you with the ability to access, rectify, port and erase your data. Learn more in your privacy settings. You can delete your account any time. When you delete your account, we delete things you have posted, such as your photos and status updates, and you won't be able to recover that information later. Information that others have shared about you isn't part of your account and won't be deleted when you delete your account. 5. DATA RETENTION We store data until it is no longer necessary to provide our services and Meta Products, or until your account is deleted - whichever comes first. When you delete your account, we delete things you have posted, such as your photos and status updates, and you won't be able to recover that information later. We may continue to store copies of this information for up to 90 days after deletion for safety, security, and integrity purposes. 6. LIABILITY LIMITATIONS Our liability to you is limited. We won't be liable to you for any lost profits, data, or any indirect, consequential, exemplary, special, or incidental damages, even if we know they're possible. This includes damages relating to the loss of data, account termination, or service disruption. Our aggregate liability for all claims relating to our service is limited to the amount you paid us in the 12 months before the claim, or $100, whichever is greater. 7. DISPUTE RESOLUTION Any claim, cause of action, or dispute you have with us that arises out of or relates to these Terms or Instagram must be resolved exclusively through binding individual arbitration. You and Instagram agree that any such claim will be personally brought by you and not as part of any class action or representative proceeding. 8. UPDATES TO TERMS We may change our Service and policies, and we may need to make changes to these Terms so that they accurately reflect our Service and policies. Unless otherwise required by law, we will notify you before we make changes to these Terms and give you an opportunity to review them before they go into effect.
